The Ministry of Climate and Environment wants to abolish the 10H rule. If this could be achieved by replacing the current restrictions with regulations favouring the development of wind farms, we would have a real revolution.

The draft law on amending the law on investments in wind power plants and certain other laws envisages abandoning the 10H rule in favour of accepting that onshore wind power plants can be built within 500 metres of residential development.

The drafters also want wind farms to be able to be built on the basis of an Integrated Investment Plan. Their aim also remains to harmonise the planning process currently contained in the Wind Power Investment Act with the general rules found in the Planning and Spatial Development Act.

These are important ideas – they may not lead to a breakthrough in facilitating the construction of wind farms, but they will certainly contribute to onshore development. In this sense, if the above draft comes into force, we will have a revolution.
